Exceptional processes require individualized assessment
Humanitarian and compassionate applications, in-Canada refugee claims and overseas refugee processes are distinct. They have different legal tests, procedures and consequences. Obtain qualified advice promptly before deciding which—if any—may apply.
Not a substitute for regular eligibility
In limited circumstances, a person may ask Immigration, Refugees and Citizenship Canada to consider humanitarian and compassionate factors in an application from within Canada. Decision-makers may consider establishment in Canada, family relationships, the best interests of directly affected children and hardship, together with the complete facts.
This is a discretionary process. It is not simply another permanent residence program and does not prevent or pause removal action by itself. Restrictions and exceptions can apply, so timing and procedural history require close review.

Refugee protection is a separate test
A refugee claim is based on defined protection grounds and is not determined by general economic hardship or a preference to remain in Canada. Eligibility to make a claim and the merits of the claim are separate questions. Evidence, disclosure, deadlines and testimony can all be important.
- Preserve identity and travel records
- Record events accurately and chronologically
- Do not omit prior applications, claims or status history
- Seek urgent professional help if a deadline, interview or hearing applies
